Terms of Service
These Terms of Service govern your access to and use of alme, an AI image generation and editing app operated by Alme LLC. By creating an account, accessing the app, or using any feature of alme, you agree to these Terms.
1. Eligibility and Acceptance
- alme is offered only to individuals who are at least 18 years old and able to form a binding contract under applicable law.
- By using alme, you represent and warrant that you are at least 18 years old, that the information you provide is accurate, and that your use of the service complies with these Terms and all applicable laws.
- If you do not agree to these Terms, do not use alme.
2. The Service
- alme is an AI powered image generation and editing service. Users may upload images, create a face profile from three facial reference photos, use templates, generate new images, edit existing images, perform swaps and transformations, and download or share results outside the app.
- Features, tools, storage limits, and availability may change from time to time. We may add, modify, suspend, or discontinue any feature at any time, with or without notice, to the extent permitted by law.
3. Accounts and Security
- You may need an account to access some or all features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must notify us promptly at support@alme.life if you believe your account has been accessed without authorization or used in violation of these Terms.
- We may suspend, restrict, or terminate accounts that appear to be compromised, abusive, fraudulent, unlawful, or otherwise in violation of these Terms.
4. Subscriptions, Billing, and Store Terms
- Paid features may be offered through subscription plans or other in app purchases made through Apple or Google. Your purchase, billing, renewal, cancellation, refund, and payment processing may also be subject to the terms, conditions, and policies of the applicable app store.
- You are responsible for reviewing the pricing and subscription details presented at the time of purchase. Except where required by law or by the applicable store, fees are nonrefundable.
- If there is a conflict between these Terms and any mandatory store requirement that applies to your purchase, the applicable mandatory store requirement will control only to the extent of that conflict.
5. Your Content
- You may upload, submit, store, generate, edit, transform, or share images, prompts, and other content through alme. For purposes of these Terms, all such material is called User Content.
- You retain ownership of any rights you have in your User Content. However, you grant Alme LLC a worldwide, nonexclusive, royalty free license to host, store, reproduce, process, adapt, modify, display, transmit, and use your User Content as necessary to operate, secure, improve, and provide the service and the features you request.
- This license includes the right to use User Content to generate, render, edit, transform, moderate, secure, troubleshoot, and deliver outputs to you, and to review content where reasonably necessary for abuse prevention, legal compliance, policy enforcement, support, or service integrity.
- You represent and warrant that you own or control all rights necessary to upload, submit, generate, edit, use, and share the User Content you provide, and that your User Content and your use of the service do not infringe, misappropriate, or violate any person's rights, including copyright, trademark, privacy, publicity, or other intellectual property or personal rights.
6. Face Profile and Image Processing Consent
- Certain features require you to provide three face profile photos taken from different angles. By creating a face profile or using personalized generation and editing features, you expressly consent to the collection, storage, and processing of those photos and related reference data for the purpose of providing the requested features.
- You acknowledge that alme may also process any other images you choose to upload, including portraits, body photos, hand photos, and other visual materials, in order to perform the edits, swaps, transformations, and generations you request.
- Your use of these features is also subject to our Privacy Policy.
7. Prohibited Content and Conduct
- You may not use alme to upload, create, request, generate, share, or distribute content that is unlawful, abusive, exploitative, infringing, or otherwise prohibited by these Terms.
- Without limitation, you may not use alme for pornographic or sexually explicit content, nudity where prohibited by law or policy, graphic violence, gore, child sexual abuse material, exploitation of minors, nonconsensual intimate imagery, harassment, threats, hate, impersonation, deception, fraud, malware, unlawful activity, or content that violates the rights of others.
- You may not use alme to bypass safety systems, probe or reverse engineer the service, scrape the service, interfere with the service, or use the service in a way that could damage, disable, or overburden our systems or those of our providers.
- We may remove content, block prompts, limit features, suspend accounts, terminate access, preserve evidence, and report conduct to service providers or law enforcement where appropriate.
8. User Responsibility for Creations, Sharing, and Rights Clearance
- You are solely responsible for the User Content you upload, the prompts you submit, the outputs you generate, the edits or transformations you request, and any decision to download, publish, distribute, display, license, sell, or otherwise share content created with alme.
- Alme LLC does not review every user prompt, upload, or output before it is created or shared, and we do not guarantee that any output is lawful, noninfringing, commercially usable, or suitable for any particular purpose.
- If you use alme to create or share content that infringes copyright, trademark, publicity, privacy, or other rights, or that violates any law, contract, or platform policy, that is your responsibility. You, not Alme LLC, are responsible for obtaining any permissions, clearances, or licenses required for your use or sharing of content.
- You must not represent that content generated or edited through alme is cleared for commercial use, free of third party claims, or approved by any person, brand, platform, or rights holder unless you independently verify that such representation is accurate.
9. Moderation, Removal, and Repeat Infringers
- We may but are not obligated to monitor content, prompts, accounts, or activity. We may investigate suspected violations, review relevant content, and take any action we reasonably consider appropriate, including warning users, removing content, restricting features, suspending accounts, terminating access, or preserving records.
- We reserve the right to remove allegedly infringing, unlawful, harmful, or policy violating material at any time. We may also terminate the accounts of repeat infringers or repeat violators.
- If you believe content available through alme infringes your rights, contact us at support@alme.life with sufficient information for us to review the complaint.
10. Intellectual Property and Service Rights
- alme, including the app, software, interfaces, workflows, templates, branding, design elements, and related technology, is owned by or licensed to Alme LLC and is protected by applicable intellectual property and other laws.
- Except for the limited right to use the service in accordance with these Terms, no right, title, or interest in or to the service is transferred to you.
- You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, decompile, disassemble, reverse engineer, or otherwise exploit any part of the service except as expressly permitted by us in writing or by applicable law that cannot be waived.
11. AI Output Disclaimer
- Outputs generated or edited by alme may be unexpected, inaccurate, incomplete, offensive, unavailable, or similar to content created for other users or from other sources.
- We do not guarantee that outputs are unique, original, accurate, noninfringing, fit for commercial exploitation, or suitable for any legal, medical, professional, or safety critical use.
- You are solely responsible for reviewing and evaluating any output before relying on it, using it, or sharing it.
12. No Warranties
- To the fullest extent permitted by law, alme is provided on an as is and as available basis. Alme LLC and its affiliates, officers, members, employees, contractors, licensors, and service providers disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and quiet enjoyment.
- We do not warrant that the service will be uninterrupted, secure, error free, timely, or free from harmful code, or that any defects will be corrected.
13. Limitation of Liability
- To the fullest extent permitted by law, Alme LLC and its affiliates, officers, members, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, business opportunities, or other intangible losses, arising out of or related to your use of or inability to use alme.
- To the fullest extent permitted by law, the total aggregate liability of Alme LLC for all claims arising out of or relating to the service or these Terms will not exceed the greater of the amount you paid to Alme LLC for the service during the twelve months before the event giving rise to the claim, or one hundred United States dollars.
- Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
14. Indemnification
- To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Alme LLC and its affiliates, officers, members, employees, contractors, licensors, and service providers from and against any claims, demands, actions, investigations, proceedings, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, your prompts, your outputs, your use of the service, your sharing or commercialization of content, your violation of these Terms, or your violation of any law or rights of another person or entity.
15. Termination
- You may stop using alme at any time and may delete your account through the app where that feature is available.
- We may suspend or terminate your access immediately, with or without notice, if we reasonably believe you violated these Terms, created risk or possible legal exposure for us or others, failed to comply with applicable law, or engaged in misuse, fraud, abuse, infringement, or harmful conduct.
- Any provisions of these Terms that by their nature should survive termination will survive, including provisions regarding ownership, licenses, disclaimers, limitations of liability, indemnification, dispute resolution, and enforcement.
16. Governing Law and Venue
- These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles.
- To the extent permitted by law, any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Washington, and you consent to the personal jurisdiction and venue of those courts.
- Nothing in these Terms limits any nonwaivable consumer rights that apply under the law of your place of residence.
17. Changes to These Terms
- We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the effective date. Your continued use of alme after the updated Terms become effective constitutes your acceptance of the revised Terms to the extent permitted by law.
