Terms of Service

Alme LLC

These Terms of Service govern your access to and use of alme, an AI image and video generation and editing app operated by Alme LLC. By creating an account, accessing the app, or using any feature of alme, you agree to these Terms.

1. Eligibility and Acceptance

• alme is offered only to individuals who are at least 18 years old and able to form a binding contract under applicable law.
• By using alme, you represent and warrant that you are at least 18 years old, that the information you provide is accurate, and that your use of the service complies with these Terms and all applicable laws.
• If you do not agree to these Terms, do not use alme.

2. The Service

• alme is an AI powered image and video generation and editing service. Users may upload images, create a face profile from three facial reference photos, use templates, create and share image and video community templates, generate new images and videos, animate images, edit existing images, perform swaps and transformations, and download or share results outside the app.
• Features, tools, storage limits, and availability may change from time to time. We may add, modify, suspend, or discontinue any feature at any time, with or without notice, to the extent permitted by law.

3. Accounts and Security

• You may need an account to access some or all features. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us promptly at support@alme.life if you believe your account has been accessed without authorization or used in violation of these Terms.
• We may suspend, restrict, or terminate accounts that appear to be compromised, abusive, fraudulent, unlawful, or otherwise in violation of these Terms.

4. Subscriptions, Billing, and Store Terms

4.1 Subscription Plans

• alme offers an optional paid subscription called alme Pro. alme Pro is available as an auto-renewable subscription through the following plans:
  • Monthly Plan — billed monthly at the price displayed at the time of purchase.
  • Annual Plan — billed once per year at the price displayed at the time of purchase. The annual plan may include a discounted per-month rate compared to the monthly plan.
• alme Pro grants access to premium features, which may include removal of watermarks from saved results, increased daily creation limits, extended result retention periods, and other benefits as described in the app at the time of purchase. Features included in alme Pro may change from time to time.

4.2 Free Trials

• We may offer a free trial period for certain subscription plans. The duration and availability of any free trial will be disclosed at the time of subscription. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee.
• Any unused portion of a free trial period will be forfeited when you purchase a subscription, to the extent permitted by applicable law.

4.3 Billing and Payment

• All subscription purchases are processed through the Apple App Store. Payment will be charged to your Apple ID account at confirmation of purchase. By subscribing, you authorize Apple to charge the applicable subscription fee to your chosen payment method on file with your Apple ID.
• You are responsible for reviewing the pricing and subscription details presented at the time of purchase. All prices are displayed in your local currency as determined by the App Store.

4.4 Auto-Renewal and Cancellation

• Your subscription will automatically renew at the end of each billing period (monthly or annually, depending on your plan) unless you cancel at least twenty-four (24) hours before the end of the current period. Your account will be charged for renewal within twenty-four (24) hours prior to the end of the current period at the then-current subscription rate.
• You may manage or cancel your subscription at any time through your Apple ID account settings in the App Store. Cancellation will take effect at the end of the current billing period, and you will retain access to alme Pro features until that date.
• Deleting the app from your device does not cancel your subscription. You must cancel through your Apple ID account settings to stop future charges.

4.5 Price Changes

• We reserve the right to change subscription pricing at any time. If we increase the price of your subscription plan, you will be notified in advance through the App Store in accordance with Apple's policies, and any price increase will take effect at the start of your next billing period following the notice. Your continued subscription after a price change constitutes acceptance of the new price.

4.6 Refunds

• All subscription payments are processed by Apple. Except where required by applicable law, fees paid are nonrefundable. To request a refund, you must contact Apple directly through the App Store or Apple Support in accordance with Apple's refund policies. Alme LLC does not have the ability to process refunds for App Store purchases.

4.7 App Store Terms

• Your purchase and use of subscriptions through the Apple App Store are also subject to Apple's Terms of Service and Licensed Application End User License Agreement. If there is a conflict between these Terms and any mandatory App Store requirement that applies to your purchase, the applicable mandatory App Store requirement will control only to the extent of that conflict.

4.8 In-App Video Credit Purchases

• alme offers in-app purchases of consumable Video Credits that you can use to generate videos and to use other users' video templates. Video Credits are currently offered in the following packages:
  • Spark — 300 Video Credits.
  • Bolt — 1,100 Video Credits.
  • Thunder — 2,250 Video Credits.
  Package names, credit amounts, and prices are displayed in the app at the time of purchase and may change from time to time.
• All Video Credit purchases are processed through the Apple App Store. Payment will be charged to your Apple ID account at confirmation of purchase. By purchasing a credit package, you authorize Apple to charge the applicable fee to your chosen payment method on file with your Apple ID.
• Video Credits are a consumable, limited, personal, nontransferable, revocable license to use the video features of alme. They are not money, not a stored value, not a security, and have no cash value. Video Credits may not be sold, gifted, redeemed for cash, exchanged for any other virtual item, or transferred between accounts.
• Videos generated through alme require Video Credits. Credits are deducted from your balance when a video generation or video template use is started. If a video generation fails due to a technical error on our side, or if you cancel the generation before it completes, we will generally return the deducted credits to your balance. We may decline to refund credits where the generation failed due to content policy violations, prohibited content, or abuse.
• Video Credits do not expire while your alme account remains active. If you delete your account, if your account is terminated for violation of these Terms, or if the service is discontinued, any unused Video Credits will be forfeited to the fullest extent permitted by applicable law.
• Except where required by applicable law, Video Credit purchases are nonrefundable. All refund requests for Video Credit purchases must be made to Apple directly through the App Store or Apple Support in accordance with Apple's refund policies. Alme LLC does not have the ability to process refunds for App Store purchases.
• Your purchase and use of Video Credits through the Apple App Store are subject to Apple's Terms of Service and Licensed Application End User License Agreement. If there is a conflict between these Terms and any mandatory App Store requirement that applies to your purchase, the applicable mandatory App Store requirement will control only to the extent of that conflict.

4.9 Pro Discount on Video Credits

• Users with an active alme Pro subscription receive a twenty percent (20%) discount on Video Credits spent to generate videos and to use other users' video templates. The discount is applied at the time credits are spent and reduces the number of Video Credits deducted from your balance. The discount does not change the price or credit amount of Video Credit packages at purchase.
• The Pro discount applies only while your alme Pro subscription is active. If your subscription lapses, is cancelled, or is otherwise inactive at the time credits are spent, the standard (non-discounted) credit cost applies. We reserve the right to change the discount rate or modify the benefit at any time, to the extent permitted by law.

5. Your Content

• You may upload, submit, store, generate, edit, animate, transform, or share images, videos, animations, prompts, and other content through alme. For purposes of these Terms, all such material is called User Content.
• You retain ownership of any rights you have in your User Content. However, you grant Alme LLC a worldwide, nonexclusive, royalty free license to host, store, reproduce, process, adapt, modify, display, transmit, and use your User Content as necessary to operate, secure, improve, and provide the service and the features you request.
• This license includes the right to use User Content to generate, render, edit, transform, moderate, secure, troubleshoot, and deliver outputs to you, and to review content where reasonably necessary for abuse prevention, legal compliance, policy enforcement, support, or service integrity.
• You represent and warrant that you own or control all rights necessary to upload, submit, generate, edit, use, and share the User Content you provide, and that your User Content and your use of the service do not infringe, misappropriate, or violate any person's rights, including copyright, trademark, privacy, publicity, or other intellectual property or personal rights.

5.1 Creator Profiles

• You may choose to enable a public creator profile on alme. Your profile information, including your display name, bio, and avatar, is user-generated content subject to the same moderation policies that apply to templates and other User Content.
• By enabling a public profile, you acknowledge that your profile information (display name, bio, avatar, and template statistics) will be visible to all alme users, including unauthenticated visitors.
• Templates you publish display a link to your creator profile. If you delete your account, your profile is removed and templates are anonymized in accordance with our data deletion policies.

5.2 Community Templates

• alme allows users to create image and video templates using their own face and to share those templates with other users of the platform ("Community Templates"). By submitting a Community Template, you grant Alme LLC a worldwide, nonexclusive, royalty free, sublicensable license to host, store, reproduce, display, distribute, and make available your Community Template to other users of the service for the purpose of generating images or videos using that template.
• You represent and warrant that you have all rights, consents, and permissions necessary to create, submit, and share each Community Template, including any rights of publicity, privacy, or intellectual property associated with any likeness, image, or other content included in the template.
• Alme LLC performs limited content moderation on Community Templates before they are made available to other users. This moderation is designed to screen for clearly inappropriate content, such as strong violence, nudity, gore, and other material that violates our Prohibited Content and Conduct policies. However, this review is limited moderation only. It is not a legal review, rights clearance, authenticity verification, or a guarantee that the template is lawful, noninfringing, safe, or suitable for commercial use.
• You, not Alme LLC, are solely responsible for ensuring that your Community Template does not infringe, misappropriate, or violate any third party's copyright, trademark, publicity, privacy, or other rights, and that it complies with all applicable laws. Alme LLC assumes no liability for any claims arising from the content of Community Templates created or shared by users.
• You may remove a Community Template you have shared at any time through the app. Removal will prevent new users from accessing the template, but copies already generated by other users prior to removal may persist.

5.3 Creator Rewards

• When another alme user successfully generates content from a Community Template that you have published, you may earn a small amount of credits as a creator reward. The exact reward amount is determined by Alme LLC and may vary by template type (for example, image versus video), by region, by promotion, or for other reasons, and may be changed, reduced, or discontinued at any time, to the extent permitted by law.
• Creator rewards are only issued for generations that complete successfully. No reward is issued, and any provisional reward may be reversed, if a generation fails, is cancelled by the user, is refunded, is blocked by content moderation, or is determined by Alme LLC to involve fraud, abuse, self-use from the same or related accounts, or any other violation of these Terms or our policies.
• Creator rewards are a limited, personal, nontransferable, revocable license to use the features of alme. They are not money, not a stored value, not a security, have no cash value, and may not be redeemed for cash, sold, gifted, or transferred. Rewards may be forfeited if your account is terminated, if your template is removed for violating our policies, or if the service is discontinued.
• You are responsible for any tax obligations that may arise from receiving creator rewards in your jurisdiction.

5.4 Creator Program (Cash Compensation Pilot)

• Separately from the in-app creator rewards described in Section 5.3, Alme LLC operates a limited pilot Creator Program under which selected Community Template creators may receive cash compensation, paid in U.S. dollars via ACH or Wise, based on usage of their Community Templates. Eligibility is by invitation and at Alme's sole discretion, and participation requires acceptance of a separate Creator Agreement that, together with these Terms, governs your participation in the Creator Program.
• The Creator Program is independent of, and does not modify, the in-app creator rewards described in Section 5.3. The cash compensation terms of the Creator Program are set out in the Creator Agreement and are determined by Alme LLC in its sole discretion; Alme does not publish per-template rates and reserves the right to vary compensation by factors such as template quality tier, output length, and complexity.
• The Creator Program is a pilot. Alme LLC may modify, suspend, or terminate the Creator Program, or any individual's participation in it, at any time, with or without cause, subject only to any prior-notice obligations expressly set forth in the Creator Agreement.
• If you participate in the Creator Program, you do so as an independent contractor. Nothing in these Terms or the Creator Agreement creates an employment, agency, joint venture, or partnership relationship between you and Alme LLC. You are solely responsible for all taxes arising from any cash compensation you receive, and Alme will issue tax forms (such as a Form 1099-NEC) where required by applicable law.
• In the event of any conflict between these Terms and the Creator Agreement with respect to the cash compensation terms of the Creator Program, the Creator Agreement controls.

6. Face Profile and Image Processing Consent

• Certain features require you to provide three face profile photos taken from different angles. By creating a face profile or using personalized generation and editing features, you expressly consent to the collection, storage, and processing of those photos and related reference data for the purpose of providing the requested features.
• You acknowledge that alme may also process any other images you choose to upload, including portraits, body photos, hand photos, and other visual materials, in order to perform the edits, swaps, transformations, and generations you request.
• You understand and expressly consent that, to generate images and videos that feature your likeness, your face profile photos and related reference data will be transmitted to and processed by third-party AI infrastructure and model providers, including Atlas Cloud, Google, OpenAI, and others described in our Privacy Policy. Each provider is governed by its own privacy policy and data-handling practices, which you should review. We send only the data needed to complete your requested generation, and alme does not use your face data to train AI models.
• By using alme, you grant Alme LLC and its sub-processors a limited, worldwide, royalty-free license to process your face profile photos and derived reference data solely to generate a character based on your likeness for use in the images and videos you request. You may revoke this consent at any time by deleting your face profile inside the app, which will stop further use of your face data for new generations.
• Your use of these features is also subject to our Privacy Policy.

7. Prohibited Content and Conduct

• You may not use alme to upload, create, request, generate, share, or distribute content that is unlawful, abusive, exploitative, infringing, or otherwise prohibited by these Terms.
• Without limitation, you may not use alme for pornographic or sexually explicit content, nudity where prohibited by law or policy, graphic violence, gore, child sexual abuse material, exploitation of minors, nonconsensual intimate imagery, harassment, threats, hate, impersonation, deception, fraud, malware, unlawful activity, or content that violates the rights of others.
• You may not use alme to bypass safety systems, probe or reverse engineer the service, scrape the service, interfere with the service, or use the service in a way that could damage, disable, or overburden our systems or those of our providers.
• We may remove content, block prompts, limit features, suspend accounts, terminate access, preserve evidence, and report conduct to service providers or law enforcement where appropriate.

8. User Responsibility for Creations, Sharing, and Rights Clearance

• You are solely responsible for the User Content you upload, the prompts you submit, the outputs you generate, the Community Templates you create and share, the edits or transformations you request, and any decision to download, publish, distribute, display, license, sell, or otherwise share content created with alme.
• Alme LLC does not review every user prompt, upload, output, or Community Template before it is created or shared. Where we do perform moderation of Community Templates, that review is limited to screening for clearly prohibited content and does not constitute a legal review, rights clearance, authenticity verification, or endorsement. We do not guarantee that any output or Community Template is lawful, noninfringing, commercially usable, or suitable for any particular purpose.
• If you use alme to create or share content that infringes copyright, trademark, publicity, privacy, or other rights, or that violates any law, contract, or platform policy, that is your responsibility. You, not Alme LLC, are responsible for obtaining any permissions, clearances, or licenses required for your use or sharing of content.
• You must not represent that content generated or edited through alme is cleared for commercial use, free of third party claims, or approved by any person, brand, platform, or rights holder unless you independently verify that such representation is accurate.

9. Moderation, Removal, and Repeat Infringers

• We may but are not obligated to monitor content, prompts, accounts, or activity. We may investigate suspected violations, review relevant content, and take any action we reasonably consider appropriate, including warning users, removing content, restricting features, suspending accounts, terminating access, or preserving records.
• We reserve the right to remove allegedly infringing, unlawful, harmful, or policy violating material at any time. We may also terminate the accounts of repeat infringers or repeat violators.
• If you believe content available through alme infringes your rights, contact us at support@alme.life with sufficient information for us to review the complaint.

10. Intellectual Property and Service Rights

• alme, including the app, software, interfaces, workflows, templates, branding, design elements, and related technology, is owned by or licensed to Alme LLC and is protected by applicable intellectual property and other laws.
• Except for the limited right to use the service in accordance with these Terms, no right, title, or interest in or to the service is transferred to you.
• You may not copy, reproduce, distribute, publicly display, modify, create derivative works from, decompile, disassemble, reverse engineer, or otherwise exploit any part of the service except as expressly permitted by us in writing or by applicable law that cannot be waived.

11. AI Output Disclaimer

• Outputs generated or edited by alme, including images, videos, and animations, may be unexpected, inaccurate, incomplete, offensive, unavailable, or similar to content created for other users or from other sources.
• We do not guarantee that outputs are unique, original, accurate, noninfringing, fit for commercial exploitation, or suitable for any legal, medical, professional, or safety critical use.
• You are solely responsible for reviewing and evaluating any output before relying on it, using it, or sharing it.

12. No Warranties

• To the fullest extent permitted by law, alme is provided on an as is and as available basis. Alme LLC and its affiliates, officers, members, employees, contractors, licensors, and service providers disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and quiet enjoyment.
• We do not warrant that the service will be uninterrupted, secure, error free, timely, or free from harmful code, or that any defects will be corrected.

13. Limitation of Liability

• To the fullest extent permitted by law, Alme LLC and its affiliates, officers, members, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, business opportunities, or other intangible losses, arising out of or related to your use of or inability to use alme.
• To the fullest extent permitted by law, the total aggregate liability of Alme LLC for all claims arising out of or relating to the service or these Terms will not exceed the greater of the amount you paid to Alme LLC for the service during the twelve months before the event giving rise to the claim, or one hundred United States dollars.
• Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

14. Indemnification

• To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Alme LLC and its affiliates, officers, members, employees, contractors, licensors, and service providers from and against any claims, demands, actions, investigations, proceedings, liabilities, damages, losses, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your User Content, your prompts, your outputs, your use of the service, your sharing or commercialization of content, your violation of these Terms, or your violation of any law or rights of another person or entity.

15. Termination

• You may stop using alme at any time and may delete your account through the app where that feature is available.
• We may suspend or terminate your access immediately, with or without notice, if we reasonably believe you violated these Terms, created risk or possible legal exposure for us or others, failed to comply with applicable law, or engaged in misuse, fraud, abuse, infringement, or harmful conduct.
• Any provisions of these Terms that by their nature should survive termination will survive, including provisions regarding ownership, licenses, disclaimers, limitations of liability, indemnification, dispute resolution, and enforcement.

16. Governing Law and Venue

• These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles.
• To the extent permitted by law, any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Washington, and you consent to the personal jurisdiction and venue of those courts.
• Nothing in these Terms limits any nonwaivable consumer rights that apply under the law of your place of residence.

17. Changes to These Terms

• We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the effective date. Your continued use of alme after the updated Terms become effective constitutes your acceptance of the revised Terms to the extent permitted by law.

18. Notices

• Alme LLC will provide notices required under these Terms — including notices of material changes under Section 17 — by posting them in the app, on alme.life, or by emailing the email address you have on file. You may give notices to Alme by emailing support@alme.life.
• A notice is deemed delivered on the date Alme sends or posts it. You are responsible for keeping your account email address current.

19. Copyright Infringement and DMCA Notices

• If you believe that content available through alme infringes your copyright, please send a written notice to support@alme.life that includes the elements required by 17 U.S.C. § 512(c)(3): (1) a physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (2) identification of the copyrighted work claimed to have been infringed; (3) identification of the material claimed to be infringing and information reasonably sufficient to permit Alme to locate it (such as a template name and a link or screenshot); (4) your contact information, including address, telephone number, and email; (5) a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner.
• Alme will respond to valid notices in accordance with applicable law and may, in appropriate circumstances, remove or disable access to the reported material and terminate the accounts of users determined to be repeat infringers.
• If you believe material was removed or disabled in error, you may submit a counter-notification to support@alme.life containing the elements required by 17 U.S.C. § 512(g)(3).

20. Force Majeure

• Alme LLC will not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, war, civil unrest, labor disputes, governmental action, internet or utility failures, or failures of upstream service providers, AI-infrastructure providers, or payment processors. Alme will resume performance as soon as reasonably practicable.

21. Assignment

• Alme LLC may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, financing, reorganization, or sale of substantially all of its assets, without your consent. You may not assign or transfer these Terms or any rights under them without Alme’s prior written consent. Any assignment or transfer in violation of this Section is void.

22. Severability

• If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

23. Entire Agreement

• These Terms, together with our Privacy Policy and any other terms expressly incorporated by reference, are the entire agreement between you and Alme LLC with respect to your use of alme and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, on that subject.
